We sometimes hear from many in our Washington County community about certain development applications, asking for updates and documents. These applications have generated a lot of questions and comments.

Laurelwood Estates Subdivision: Casefile L2400303-S

  • Proposed Development: 30-lot subdivision approved by the Hearings Officer in May 2025.
  • Location: South side of SW Laurelwood Road at its intersection with SW Hartley Road.
  • Land Use Districts: AF-5 (Agriculture and Forest)
  • Conditions: Development will occur in phases, with final approval required within 5 years of preliminary approval.
  • Application: Type II procedure. Accepted 01/23/2023.

11/25/2025 - LUBA Final Opinion and Order

On November 25, 2025, LUBA issued their Final Opinion and Order which upheld the County’s action on three potential assignments of error and remanded the fourth for a near hearing. Parties had until December 16, 2025, to appeal the LUBA decision to the Court of Appeals. No appeal was filed, and the County will proceed with scheduling a hearing to address the issue identified in the LUBA decision pertaining to the proposed access. The hearing will be limited to this issue only and no other aspects of the proposed subdivision will be reviewed.

Notice of the rehearing date will be posted here at least 20 days prior to the hearing, and mailed to property owners within 1,000 feet and to all parties who have appeared in the record for the original hearing.

6/02/2025 - Notice of Intent to Appeal

On June 2, 2025, Marcus Umstead and Jill Pruitt, Petitioners, filed a Notice of Intent to Appeal Washington County Case File L2400303-S to the Oregon Land Use Board of Appeals (LUBA). It was assigned LUBA No. 2025-040.

5/12/2025 - Notice of Decision

On May 12, 2025, the Washington County Hearings Officer issued a written decision (Attachment “C”) approving an application for a 30-lot subdivision (Laurelwood Estates) in the AF-5 District at 13665 SW Academy Way in unincorporated Washington County. The subject property is identified as Tax Lot 2S3 05 2400 within CPO 10.

The Hearings Officer’s decision is as follows: ORDER: The Hearings Officer approves Casefile L2400303-S (30-lot subdivision in the AF-5 District) subject to the conditions of approval in Attachment B of this Final Order.

4/7/2026

The Portland Golf Club has submitted an application for a Director's Interpretation for dredging and dewatering of pond sediment onsite at the Portland Golf Club.

2025

12/04/2025
Grading Inspectors visited the site and identified some ground disturbing activity. A stop work notice has been posted on the property and a letter was sent to the Portland Golf Club requesting that they contact the County.


10/24/2025
DEQ has determined that the Portland Golf Club would need a Solid Waste Letter of Authorization to store the dredged materials at the proposed location.

To move forward in that DEQ process, a new Land Use Compatibility Statement (LUCS) would be required from Washington County. Washington County would not be able to issue a LUCS for this use because the County does not allow the storage of solid waste in the R-5 zone for any duration.

Grading Permit: The Portland Golf Club has submitted its grading permit application to Washington County. However, no permits will be issued until all state and local environmental permit requirements have been met.


10/14/2025

Washington County has received formal communication from DEQ.

DEQ has confirmed its determination that the dredged material is considered “solid waste” and they are now working with the applicant to determine what DEQ permits will be required.


10/02/2025

Permit Status

  • Environmental agency review: Washington County is awaiting review and documentation from the Oregon Department of Environmental Quality (DEQ) and other environmental agencies.
  • Grading Permit: The Portland Golf Club has submitted its grading permit application to Washington County. However, no permits will be issued until all state and local environmental reviews are complete.

Next Steps

  • If DEQ classifies the material in the biobags as “solid waste” this would represent a significant change in the project.
  • If there are significant changes in the project, then it couldn’t move forward as conditionally approved.
  • In that case, the applicant could consider submitting a new or modified land use application which would be subject to a Type II review process. Due to community interest, LUT would elevate the application to a Type III process. This process would include public notice, opportunities for public comments, and a public hearing in front of an independent hearings officer.
2023

07/19/2023

Washington County Development Review/Current Planning issued a conditional land use decision approving this application on May 26, 2023, – after the May 23, 2023, statutory 120-day deadline. Community Participation Organization (CPO) 3 filed an appeal on June 15, 2023.

The Portland Golf Club filed a mandamus action in Washington County Circuit Court on July 18, 2023. This action seeks to terminate the appeal on the basis of Washington County Development Review/Current Planning’s failure to take final action on the application, including resolution of any local appeals, before the May 23, 2023, statutory 120-day deadline.

The applicant must meet Conditions of Approval (see Notice of Decision and Staff Report, Appendix B) which include required regulatory environmental permits before work can begin. Learn more about the conditions of approval.

On April 20, 2026, LUT staff corrected the notice of decision to address an incorrect reference to the wrong casefile on page 1 of Attachment B, Conditions of Approval, and page 3 of Attachment C, Staff Report.


04/08/2026

On April 7, 2026, LUT staff approved a modification of a prior condition of approval for a three-lot partition in the Cedar Mill urban unincorporated area. When the partition application was processed in 2023, there was a recent Code Violation on the property related to the use of the former horse arena located on the original parcel. A condition was included in the partition approval to document the resolution of the complaint, as well as to ensure that the former horse arena would be used in compliance with the requirements of the Washington County Community Development Code.

The original condition read:

No public use of the soccer facility/former horse arena shall occur. No for-profit or not-for-profit commercial use for soccer camps and/or training sessions or sports clinics shall be conducted on the site. Use will be limited to members of his immediate family.

The original condition was ambiguously drafted, creating confusion regarding the acceptable use of the former horse arena for both the property owners and neighbors. The original condition inadvertently applied to all of the parcels created in the partition rather than to just the parent parcel containing the former horse arena, caused confusion about uses permitted in the structure, and raised legal concerns about Washington County’s ability to enforce the specific clause related to “his family.” Conditions of approval run with properties in perpetuity, even if ownership changes, so any such conditions should not be tied to a particular individual or family.

Given these concerns with the language in the original condition, and because there had been no additional reported Code violations, LUT staff initiated a new casefile with the intent to remove the original condition. During the public comment period for the new casefile, LUT staff received information that neighbors continued to have concerns that the former horse arena was not being used in compliance with the requirements of the Washington County Community Development Code. Based on these comments and supporting evidence of possible Code violations, LUT Staff determined that a modification of the condition was appropriate rather than its removal.

The revised condition reads:

No use of the approximately 6,720 square-foot pre-existing structure located in the northern portion of Parcel 1 is allowed by the general public. Only those uses expressly permitted in the Washington County Community Development Code for the R-6 land use district (Article III, Section 303) and approved by any applicable review procedure, subject to any associated development standards (including, but not limited to Article IV, Section 430), shall be allowed. Occupancy shall be limited to less than 10 persons at any time.

The revised condition not only addresses neighbors’ concerns about permissible activity in the former horse arena, but is also specific to the property and the structure enabling the County to enforce the condition.

The Staff decision to modify the condition of approval can be appealed to the County’s independent Hearings Officer by 4:00 pm on April 20, 2026. Appeal information is available in the Notice of Decision.
