Liquor, Marijuana and Psilocybin Applications

Washington County makes recommendations as part of the application process for liquor, marijuana and psilocybin operations, in unincorporated Washington County only, before applications are reviewed/approved by State of Oregon agencies.

The Oregon Liquor and Cannabis Commission (OLCC) regulates the manufacture, distribution and sale of alcoholic beverages and psilocybin in Oregon. The Oregon Health Authority (OHA) regulates psilocybin operations.

Under Oregon Law, local governments are required to make recommendations and/or approvals on state applications for businesses involving liquor, marijuana or psilocybin before the applications are approved/issued by either the OLCC or OHA.  Washington County only reviews applications for businesses and operations located in unincorporated Washington County. 
 

Is my business/proposed business in unincorporated Washington County?

We can only make recommendations for businesses located in unincorporated Washington County. Before starting any part of the application/approval process, visit MetroMap to see where your business is located. Follow these instructions:

  1. Visit MetroMap
  2. Click "I Accept"
  3. Enter your business address in the upper left and click/tap "search"
  4. Scroll down to "Jurisdiction" under "Political Boundaries" on the left.
  5. Continue with the applications process only if the jurisdiction shown is "Unincorporated Washington County." 
     

Liquor License Application Process

As per statute, Washington County will complete its review within 45 days of receiving all application materials.

Make sure the location of your proposed operation is in unincorporated Washington County.

Washington County Department of Land Use & Transportation (LUT) review. 

  1. Visit OLCC Alcohol Licensing and Permits for more information to determine which application you need for your business. The most common applications include: 
  2. Confirm these requirements:
    • Does the property have land use approval to operate the proposed business at this location?  If "no" or if you are uncertain, email [email protected]
  3. Download and complete the application.
     
  4. Pay fees online using the Public Permitting and Services Portal.  First-time users need to create an account. Watch the How-to Register video.
     
  5. Send the completed application to [email protected] or via US Mail or deliver in person to:

Once the above steps are complete, LUT staff will forward your application to HHS for review.

Washington County Health and Human Services (HHS) review

  1. Complete and submit the HHS Liquor License Additional Information form
     
  2. Confirm these HHS requirements:
    • Does the property have an approved small drinking water system or obtain water from a water provider?
       
    • Does the establishment have a septic system that has been evaluated for proposed use of have a connection to public sewer?
       
    • Does  the establishment have an Oregon Department of Agriculture permit or Washington County food service license?
       
  3. If any of the responses above are "no," contact HHS at 503-846-8722 or email [email protected]

Once County reviews are complete

  1. Both LUT and HHS will notify you of their recommendations when reviews are complete. 

    • If LUT recommends that the application be denied, email [email protected] for further instructions.

    • If HHS recommends that the application be denied, email [email protected]

  2.  If both LUT and HHS recommend that the applications be approved, email both  the final recommendation and completed application to OLCC at [email protected]. See OLCC Liquor Licensing for more information.

Marijuana Grow, Processing, Testing or Retail Application Process

Make sure the location of your proposed operation is in unincorporated Washington County.
 

  1. Visit Marijuana and Hemp (Cannabis) for State of Oregon information on marijuana operations.
     
  2. Check the Land Use District of your property. See map. The Washington County Community Development Code (CDC) Section 430-80 regulates which land use districts allow marijuana facility operations. Email [email protected] to confirm.
     
  3. A land use application is required for a new marijuana production (grow), processing, testing or retail business. See Land Development Process Fact Sheet.

    Land use reviews may also be required for some wholesale marijuana businesses. Changes in business operations of existing facilities may also require a new land use application.   Email [email protected] for information.

  4. Once the land use application is approved, you need to download and complete an OLCC Land Use Compatibility Statement (LUCS).

Psilocybin Operations Application Process

Psilocybin is a psychedelic compound found in more than 200 types of mushrooms. In 2020, Oregon voters approved regulated psilocybin manufacturing, processing, transportation, sales and supervised administration. See ORS 475A.

The Washington County Community Development Code (CDC) does not have specific allowances for psilocybin uses. LUT Planners are working on potential standards that address the time, place and manner for each type of psilocybin operation. In the interim:

  1. Contact Development Review/Current Planning staff at [email protected] or 503-846-8761. Staff will consider requests for psilocybin uses allowed in the CDC:
     
  2. Submit the LUCS to OHA after it is approved by Washington County along with your application.
    • OHA will review the application for compliance with state regulations, including time, place and manner of the psilocybin operation.
